General Terms of Use

The following general terms of use (hereinafter referred to as the “General Terms of Use” or “GTU”) apply to and govern the use of the website (hereinafter referred to as the “Website”) and the hub.inowai.com platform (hereinafter referred to as the “Platform”) of the INOWAI group.

INOWAI reserves the right to modify these General Terms of Use at any time and at its sole discretion. The modified GTU will automatically apply to the Website and the Platform.

INOWAI guarantees users access to the Website and the Platform 24/7, subject to maintenance operations and the limitations mentioned in these GTU.

By using the Website and the Platform, you acknowledge and agree that INOWAI will conduct maintenance operations on the Website and the Platform and that any access interruptions resulting from such maintenance shall not be considered a fault of INOWAI under these GTU.

By continuing to browse the Website and the Platform, you acknowledge that you have read and understood these GTU, agree to be bound by them, and have reviewed our Privacy Policy.

 

1. Purpose and Scope of the Document

The purpose of this document is to inform you about the terms of use of the Website and the Platform and the rules applicable to their access and use.

We are a group of companies (hereinafter referred to as “INOWAI,” “the Group,” “we”), which includes the following entities:

For the purposes of these General Terms of Use, the terms “you” and “your” refer, individually or collectively, to:

  • Users of the Website and the Platform,
  • Tenants and prospective tenants of a property managed by a Group company,
  • Clients of the Group, including property owners, prospective buyers, and landlords.

 

2. Artificial Intelligence Technology

In addition to the traditional property search by filters, INOWAI provides an artificial intelligence (AI) technology on its Platform that allows users to visualize available properties and interact with a virtual assistant. Designed to optimize property visibility and valuation, this interactive system provides detailed information on property features (type, number of bedrooms, amenities, etc.) by querying the Group’s database directly.

The AI relies on continuously evolving machine learning algorithms. Although we commit to regularly updating the data, we do not guarantee its completeness or absolute accuracy. In this context, you acknowledge that:

  • The data provided by the AI may be incomplete or contain inaccuracies due to the probabilistic and evolving nature of its algorithms.
  • The AI should be considered a supplementary information tool rather than a definitive source. It is the user’s responsibility to verify the accuracy of the information by consulting the property listing or contacting a Group representative.
  • The Group implements regular data update mechanisms, with a minimum update frequency of once per month, while recognizing that real-time updates cannot be guaranteed due to technical constraints.

2.1. Transparency and Algorithmic Bias

The AI-powered property search engine is based on machine learning algorithms that analyze various data from the Group’s database. These algorithms apply ranking and relevance rules that may influence the display of search results.

Therefore, the Group informs its users that:

  • Some properties may be underrepresented in search results due to technical parameters of the algorithm and not because of any deliberate exclusion.
  • The display of properties may be influenced by criteria such as the listing date, popularity, or trends observed on the Platform.
  • The Group performs regular checks to prevent significant distortions and ensure fair visibility of the available properties.

Users are encouraged to contact the Group directly if they believe a property should appear in their search results.

2.2. Property Display and Technical Limitations

The AI-driven search engine applies specific filtering and relevance criteria. Consequently, certain properties may not appear in search results, even if the selected criteria match the property’s characteristics. This can be attributed to:

  • Ranking rules defined by the algorithm.
  • Synchronization delays between the database and the user interface.

If a property does not appear in search results, the Group commits to reviewing the situation and making adjustments where possible but does not guarantee systematic visibility for each query.

3. Personal Data Protection

The Group processes user data in compliance with the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679). For more information, please refer to our Privacy Policy:

4. Liability

The Group makes every reasonable effort to ensure the accuracy and updating of the provided information. However, it shall not be held responsible for any consequences resulting from the use of the data provided, except in cases of gross negligence, willful misconduct, or a clear failure to fulfill its reasonable obligations regarding data updates and verification.

5. Breach of GTU

In the event of a breach of your obligations under these GTU, INOWAI may prohibit or suspend access to the Website and the Platform. You shall not be entitled to any compensation based on the suspension or prohibition of access to the Website and/or the Platform due to your exclusive fault.

6. Intellectual Property

The Website and the Platform remain the exclusive property of INOWAI. Access is granted to the user for strictly personal use and shall not be interpreted as a transfer or assignment of intellectual property rights in their favor.

8. Governing Law and Jurisdiction

These General Terms of Use shall be governed and interpreted in accordance with the laws of Luxembourg. In the event of a dispute, and if the parties cannot resolve it amicably, the user and INOWAI agree to submit the matter to the courts of Luxembourg or, if different, the competent jurisdiction as defined by applicable judicial competence rules.
